If I got a DUI in May 2005, should I report this on job applications even after I completed probation?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
The best policy is to report it and explain what you learned going through that experience, how you have changed your behavior, etc. if you do not report it and they find it, you will be labeled as a liar and they will not hire you, give you admission to school, etc DUI's stay on your record forever - I fully expect them to see it. You may wish to get your own criminal record by requesting it from a background check company. Beware that some background check companies may not have all the information that others do.

If the officer didn't see me drive can he arrest me for DUI?

CAN he? Of course, he did, didn't he? When arrested for DUI, whether alcohol or drugs, then upon release from jail or booking the defendant is given documents that include a notice that you have only ten days to file a request with DMV for a hearing on an appeal of the automatic suspension of your license imposed by DMV upon your arrest. That is separate and runs consecutively with any suspension that may be imposed by the DMV, or the court upon conviction. Contact DMV and do so, timely if you think you have grounds for appeal, then appear at the scheduled DMV appeal hearing and present any supporting evidence and testimony.

Can my son get his DUI dismissed since he didn't take the breath test?

Find a local attorney and see if you can fight this charge. A failure to submit to a BAC test will have serious implications for the DMV but might assist in the criminal case.
