Is it possible for someone to serve a mandatory 60 days twice?

default-avatar
Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
He is not doing the mandatory jail time twice. A DUI is punishable by up to 1 year in jail. When he was convicted, he probably received a suspended sentence. This means that the judge sentenced him to 1 year in jail and suspended all but the initial 60 days, which was mandatory, based upon his criminal driving history. 365 - 60 = 305 days that the court holds over your husband's head to ensure that he complies with all conditions of probation. Probation lasts 5 years on a DUI. If your husband violated some condition of probation, the judge may have ordered him to serve additional time.

Is a second aggravated DUI charge that is four times over the legal limit a felony?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
DUI/DWI lawyer at Catchick Law, P.C.
If he is being charged under the relatively-new "High BAC" or "Super Drunk" law, it is 180-day max Misdemeanor, BUT if your son has 3 or more DUI's in his lifetime, then it is charged as a Felony under something known as "Heidi's Law."

Does your BAC play a role in DUI sentencing?

Answered by attorney Patrick Owen Earl
DUI/DWI lawyer at Patrick O. Earl
Sentencing guidelines are the same for a blow of .08 - .14?? .15 and higher are a higher guideline. Both also are raised if it is a 1st, 2nd or 3rd offense DUI. If a person refused to blow in the BAC machine and the State has enough testimony/evidence to show the court that the person was affected by alcohol and/or drugs then a refusal is treated as blowing the same as .15 or higher.
