You have to convince the DMV to give you your license. To do so the program you attended must meet the requirements of a 1st time dui program. Talk to the program and see if they can help you out. Your other option is to attend and complete the dui program. This is probably an easier and faster way to get your license.

Normally the traffic court judges will dismiss the cases when the cop doesn't show. But there is no hard and fast rule. Maybe that commissioner doesn't believe in doing that.
