What does a failed breathalizer test paper look like and a passing one?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
They look the same. The difference is the breath test level. A reading of .08 or above is a "failed" test because that is the legal limit. A "failed" test could also result if the person refuses to take the breath test.

What are the penalties of giving urine to a person who is charged with DUI and on probation for a urine test?

DUI/DWI lawyer at Austin Hirschhorn, P.C.
If caught you could be charged with obstruction of justice. I have no idea why anyone would ask you to do this and why you would even consider doing something so stupid.

Should I expect jail time till next court date?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
If the warrant is quashed, then you will not necessary go to jail if you admit to violations, you will be re-sentenced - sometimes this is jail and sometimes it is to get the probation conditions finished with some additional community service or something like that if you can get back in classes and do some community service prior to the court date, that will help.
