You can refuse the alcosensor, which you did. When you get to court you get to explain how you blew a .06 coming from AA, which the jurors will suspect is a lie.

I got a DUI in a passenger seat and it was dismissed in court. How do I get DMV to give me my license back?

Answered by attorney Ezra N. Goldman
DUI/DWI lawyer at Law Offices of Ezra N. Goldman P.C.
This is like when people call the doctor on the radio, describe a symptom for 15 seconds and accept his advice over the doctor that has been treating them for 20 years. I am not going to second-guess your lawyer. Ask him.

The short answer:  If the person is actually charged and convicted of a fourth DUI, it can be a felony punishable from one (1) to five (5) years in prison or on probation; 90 days in jail is the minimum, $1000 in fines minimum and up to additional $4,000 in fines. There are numerous other conditions that can aggravate the sentence including but not limited to: Defendant's driving record, children in the car, other convictions, prior probation violations, etc. etc.
