Yes. It is normal to take several months to file charges. They may still be investigating or they may have a backlog of cases.

Can a hearing officer ask for a date change? Could I get the case dismissed?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
In Colorado, you must have your hearing within 60 days of the date of your request. If the hearing is set outside the 60 days, you may get it dismissed. It would depend upon the facts surrounding the reason for the continuance. Although it's a crappy situation, this will not just go away and it will not do so quickly. You may consider retaining an DUI attorney in your area.

It's a possibility. I suggest that you consult with an experienced criminal/DUI defense attorney. She can review your case and advise you of your options.
