Can police give me a DUI with no alcohol or drugs in my system?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
They will have to have some evidence of your intoxication.. They would have to have something that would show your blood alcohol content (BAC) or that illegal drugs were present in your system or that you were under the influence of prescription medicine while you were driving. Keep in mind that anybody can be charged with anything. It is one thing to be charged, it is another matter entirely to have your guilt proven beyond a reasonable doubt. Consult with an experienced DUI or OWI attorney in your area.

Can a police officer sue me for saying yes when he asked me if I had been drinking?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
First, you are not being sued by the officer. The statements made to a police officer prior to arrest can, and often are, used against the person saying them. Your situation may involve your Miranda rights, you need to contact a DUI attorney to discuss the facts of your case, you may have facts that help you avoid conviction or result in a lesser charge.

What will happen if I can't find 3rd DUI in multiple background check?

No, sorry, that is strange. Can you get a driver's license or did you still have two convictions within 7 years? I had a case like this and it appeared that the court did not send the conviction anywhere, just in their file. Have you ordered a copy of your Michigan Master Driving Record to see if you are eligible for a license? I suppose you could contact the court and ask them why it has not been abstracted, but if it is, it will appear that your 3rd conviction was this year, not six years ago.
