Can I be charged with 23152(b) if I refuse the BAC tests?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
I would need to know more facts; however, the prosecutor can introduce into evidence the fact that you refused the tests. If the judge or jury hears that, how do you think they will interpret that? You say you were "super wasted". That may be enough (especially if there is a video) to have you convicted, even without the test results.

What if I was arrested for a DUI by an officer in training?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)
DUI/DWI lawyer at Gregory Casale, Attorney at Law
I do not think that his training status will change anything as far as the charges go. So long as he is a sworn officer, he/she has the right to arrest. It may effect his testimony if it goes to trial. I don't know what role s/he played in the investigation and or arrest.

If the officer didn't see me drive can he arrest me for DUI?

Answered by attorney George Martin Derieg (Unclaimed Profile)
DUI/DWI lawyer at The Derieg Law Firm
The officer would either have to have witnessed you driving the vehicle, or another witness who would be required to come in to court.
