Not likely, but sometimes they put you on monitored sobriety and pre-trial supervision when they find out the BAC is high 2nd in 5 years involves extra dmv consequences and mandatory jail.

If the diversion agreement was after the offense, it will not affect it. Unless, there was some other part of the agreement you failed to live up to or lied about. FYI - a question about other pending charges that you did not disclose the new charges.

The prosecutor can legally charge you with DUI even if you are asleep in your car because there is the possibility that you were either driving drunk and pulled over to sleep it off, or you would wake up soon and decide to drive home while you were still drunk. This happens all the time. Hire an experienced DUI attorney to represent you if you want to avoid having a DUI conviction on your permanent record.
