Yes. You will get charged pending the blood test reports. Get an attorney as soon as you you get charged and speak to no one else.

On the return date of the ticket, ask for a lawyer to be assigned to represent you. You will have to fill out a financial aid form. I know in the Yonkers City court, the criteria for getting an assigned attorney is that you make less than $400 per week, and don't own a car or home. Mention that you are supporting your child (if you are) and that should help. If you need a hardship hearing, that is, you need a car to drive, you must ask for the hearing before entering a plea of not guilty.

Will I be charged for DUI if I just to sit in a parked car drinking and not driving but key in ignition for heat?

Yes, you could be. In Utah, you need actual physical control of the vehicle while being too drunk to drive.
