You cannot get a wet reckless if you have already plead guilty. Your blood alcohol was obviously just on the boarder of the presumption, .08%. If you have not appeared you need to get an attorney to handle your case. The DA may argue you fell asleep because of the effects of the alcohol and that you were not operating with normal care or they may also argue the .08% charge which has the same penalties.
You cannot get a wet reckless if you have already plead guilty. Your blood alcohol was obviously just on the boarder of the presumption, .08%. No, don't bother writing a letter to the judge, because he is prohibited from having any contact with a party [you] without the other side [the prosecutor] being present. The court clerk would send you back a letter telling you that, and advising you to get an attorney or come to court yourself for the hearing required to deal with your problem. If you didn't finish all programs and requirements imposed by the court, your probation can not be over. Instead, you almost certainly have a warrant for your arrest for failure to appear and probation violation. You should contact the clerk's office of that CA court with your case # and all your personal ID info, and have them check the file to determine WHAT your case status is. If there is no warrant, I'd be surprised. Even if there isn't, you'll still have to do your AA and other requirements and get the court case actually closed before you will get a license re-issued in CA or any state. You also will have to fulfill all DMV requirements imposed on you at the time, or now, before they will reissue. To obtain court permission to do any program out of state, you'll have to appear in the CA court, either personally or through an attorney you hire, to have a hearing to seek a court order authorizing what you want, IF the court will grant it. They may, if you provide proper evidence to the court that the CA DMV will accept your local AA or other program imposed on you. Contact them now to determine what is required to get their authorization. Then, once you complete the program and submit proof by the date required by the court, the case will be over, unless the court extends your probation because of your failure and probation violation. I can't speculate on that. If there IS a warrant: To handle it, you must turn yourself in to the issuing court, with or without an attorney. On misdemeanors like this, an attorney can appear in court without the defendant being present which is safer and avoids immediately being taken into custody. You'll try to negotiate a recall of the warrant[s] and bail reduction or OR release.
