For a Public Intoxication charge the officer is not required to administer a Breathalyzer test. they may rely on their own observations to determine probable cause for arrest, such as stumbling, slurred speech, or other acts. Of course, those observations are subject to scrutiny in court, and especially a jury trial, where your lawyer can ask about the lack of Breathalyzer use, but it is only one fact to be considered. How does a DUI appears if it occurs in a different state than the licensing state?

That's a weird Montana law and I don't know Montana law, but what I take from it is that they have something less than a DWI. So, even if they report it to Texas it won't satisfy as a prior DWI in Texas. And Texas will treat it the same as Montana. It may be on your record, but looks like it will just be on your driving record and not criminal record.

It depends on the policies regarding this program, these are set by the county department of corrections. I have never had a client arrested on the spot for failing to enroll in the community service in a timely fashion. You should consult your lawyer regarding the policies in your county.
