If a misdemeanor, and no court case filed within 12 months from arrest. You are safe. None can be filed in California. There is a 1 yr statute of limitations for misdemeanors. However, there is a process for petitioning to have your arrest record sealed/destroyed and requesting that the arrest be deemed a detention, instead of an arrest, by the agency. Contact a local attorney to discuss your situation.

Your ticket will not be dismissed, especially when the judge knows you cannot be 3.24, and .324 is a stone cold alcoholic. You can continue to demand perfection from the police, while you are a stone cold alcoholic. I recommend that you retain an attorney to prepare for what is coming.

Chances are the DA won't file unless your under 21. There is no way your reading could have gone from .10 to .05 in 45 minutes. The range of elimination is .01 to .02 per hour. That means that the machines were not working right or you were absorbing alcohol causing impossibly high first reading. This means your actual bac at the time of driving was less than .05. There is a statutory presumption that at a bac less than .05 a person is sober.
