If he becomes abusive immediately file a restraining order and ask for a kick out order so he has to leave the house. Never stay in an abusive situation. If he attacks you, call the cops. You can't enjoy a house if you're dead or in hospital. Opinion not legal advice.

In order to file for an uncontested divorce, you need to be able to get your husband to sign a document known as a "Waiver of Citation." Otherwise, you will need to file a divorce petition in your county, attempt to serve him with the paperwork, allow him to answer the divorce petition, and try to come to an agreement about what will happen with the property the two of you acquired during your marriage. The court does not automatically know you signed a prenuptial agreement. If it is enforceable, it is up to you to assert your rights under it in the divorce proceeding. The money your husband is currently making is community income, and you may be able to get a court order for temporary support, including attorney fees, in order to make sure you and your child are properly looked out for in the proceeding.
