Am I entitle to anything if I file for divorce

Answered by attorney Andrew M. Lloyd
Divorce lawyer at Lloyd Associates, PLLC
I am unsure whether you have gained residency, based on your inquiry; however, assuming you have - you can file in the county in which you have resided for 90 days (as long as you've been in Texas for 6 mos.) and the adultery issue simply gives argument as to why you should receive more than 50% of the community assets you have acquired during your marriage.  Feel free to contact me with further questions.

What is the percentage of income that can be designated for alimony after a divorce? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
In Wisconsin there is no statutory percentageeither minimum or maximumfor maintenance. (There are statutory standards for child support.) Instead maintenance is on a case by case basis. The goals, the courts have said, can be to try to maintain both spouses at the standard of living they enjoyed before the divorce (which is almost impossible unless both spouses are physicians), or else to 'rehabilitate' the lower-earning spouse by supporting her or him while s/he gains the skills or training necessary to return to the job market with adequate skills. Good Luck. p.s. Retain a skilled family law attorney. It's almost always worth the expense.

Husband has been gone 8 years and i can't find him to sign the divorce papers . can i still divorce him

Answered by attorney Ronda Elizabeth Harris
Divorce lawyer at Harris Law Firm, PLLC
Yes, you can file for a divorce by publication.      Divorce by publication happens only after a judge has been convinced, based on a sworn declaration, of the serving party's inability to find the Defendant after a "diligent search." Service by publication is commonly used in a divorce action to serve a spouse who has disappeared without a leaving a forwarding address. In Texas, divorce by publication is not an easy route to go. Divorce by publication has more steps, is more complicated, and is more expensive than an agreed divorce. In short, it is easier and cheaper if you can find your spouse and get them to sign off on the final divorce decree, but you can still get divorced.
