How many years do you have to be divorced to file alimony?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
Divorce lawyer at Catchick Law, P.C.
Do you mean: "How many years do you have to be married?" If so, in Michigan, there is no "set length" you have to reach before asking for spousal support (spousal support is the technical term for "alimony" in Michigan). The length of the marriage is but one of several factors a Michigan Court will look at in determining whether to award spousal support.

I need to know how to get a divorce with no income and two young children.

Answered by attorney Gilbert Borman
Divorce lawyer at Borman-Lahti PLLC
Divorce is messy and difficult. You need to find a divorce attorney as soon as possible. Contact Michigan lawyer referal at 800 968 0738 If you are still in the residence, and it is safe to do so, I recommend staying there until your divorce lawyer gives you further advice. If you are in physical danger, do not hesitate to seek a PPO, even if there is only 1 domestic disturbance on record, he likely has a criminal record related to his drug abuse which will support your request for a PPO. The most important thing is to keep you and the children safe. If for any reason you do not feel safe, call the police, if you feel you cannot stay safely where you are, get to someplace safe fast. Best of luck to you I wish you strength in this ordeal.

How long do I have to wait after my divorce is final to get remarried in the state of Michigan?

Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
Generally you only have to wait until the judge signs the divorce judgment. However I recommend you wait 30 days after the judgment is entered because that is the appeals period.
