It depends on how the final judgment is worded and whether or not the proper disclosures were made during the divorce process.  Worse case is the ex would be entitled to only three years worth of pension which would be prorated but not without a court order - in other words, it would be a very small amount.  Dividing up a pension is a very complicated matter and requires what's called a QDRO.  A QDRO will not be honored unless signed by the judge.  The ex would need to pursue this and if so, I would recommend getting a lawyer to help you with this.

You start by filing a petition for dissolution. The house presumably belongs to both of you. Once the dissolution is filed, you can ask the court to order him to move as long as you can pay the mortgage on your own. Get a lawyer. This is complex.

If you waived spousal support in the dissolution pursuant to stipulation or uncontested hearing, you may have a possible remedy for relief from that portion of the judgment under Family Code Section 2121 and 2122 on the grounds mistake. If the court reserved jurisdiction over spousal support you can file a motion to modify the judgment to award support based on change in circumstances.
