Can I obtain a divorce when spouse's whereabouts are unknown and we've been separated over 20 years?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)

Yes, you can obtain a divorce even if you cannot locate your spouse. After your file your Petition with the court, you must attempt find her and have her/him personally served with the paperwork. You must contact her last known residence, her/him last known employer, as well as her/his relatives and friends that you know of, also you should check Facebook and the internet. If all of those things fail, you can submit a request to the court to have your spouse served by publication (newspaper). Outline your attempts at finding her/him, and if the court believes you have done enough and she/he cannot be found, then they will allow you to serve by publication. Once that is completed the case can move forward without her/him.

How long does it take for a divorce to be finalized after advertising the petition in the newspaper?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Divorce lawyer at Steven J. Alpers, A Professional Corporation
There is time for the ad which gives 30 days to answer then a request for a default judgment can be filed. At that point it may take days or weeks for the judge and clerks to process the papers depending how busy the court is.

If I leave, am I still entitled to spousal support?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
Spousal Support may be ordered if one spouse makes significantly more money than the other spouse makes (or is capable of making), regardless of sex, fault, or who chose to divorce.
