How can I get a divorce if I am no longer a resident in the state where I got married?

Answered by attorney Loren Paul Zahn (Unclaimed Profile)
Divorce lawyer at Zahn Law Office
You can file in the state you are a resident of at the time you seek a divorce. In California, the requirement is that you be a resident of the State of California for six months before filing for divorce, and a resident of the County in which you file for at least 3 months. Even if you don't meet the residency requirement, a work around is possible that will allow you to file now.

If my husband cashed in his 401k which was accumulated during our marriage, how does it get handled during equitable distribution?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Generally, a 401(k) is a marital asset. Its distribution is dependent upon all of the facts in the case, the fact that he cashed it in only means you converted from a 401(k) to some other asset. If that was done during the course of the divorce the court will not be pleased and will most certainly make them account for it.

I would like to file for a divorce in VA but I married in FL and I currently do not have any idea where my husband resides what can I do about that?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
Having been married in FL does not automatically mean that you must file a divorce here. If the Husband resides in FL it can be filed in FL. To file in VA you would have to confer with an attorney there.
