If your husband won't sign the waiver of service, you will need to have him served at his work address or home address if you two are separated. You will need to request a citation from the court and you can send the petition via certified mail or a process server can personally deliver it for a fee.

If the house was purchased with money you had before you got married, it is your separate property but you will owe your wife some reimbursement for payments made on it during the marriage. It doesn't really matter how title is held if both of your money was used to acquire the house.

You need to hire an attorney to file a divorce petition for you. Also, you need to have that attorney to file a rule to show cause why you should not be granted exclusive use of the vehicle until the community property is partitioned.
