Splitting Bills during the 60-120 day cooling period

John Michael Frick
Answered by attorney John Michael Frick (Unclaimed Profile)
Divorce lawyer at Reid Dennis Frick, PC
That is untrue.  Typically, when parties file for divorce, they either agree or the court enters temporary orders detailing which party gets exclusive temporary use and possession of real estate, motor vehicles, and potentially other property and which recurring bills each party is ordered to pay during the pendency of the case.  Such temporary orders may also include temporary support for a spouse or any children of the marriage, interim attorney fees if one party in in control of most of the community funds, and a parenting plan for custody & possession of any children. It is not automatic that each spouse must pay 1/2 of all bills.

Am I entitled to part of my ex husband's retirement?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
Absolutely do not sign anything! Go see a lawyer in your community to protect your rights. You are entitled to one-half of everything earned in the retirement account during your marriage. Again, do not hesitate to talk to lawyer. You stand to lose a great deal.

What can I do if she threatens to sue me if I don't pay her in full then?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
If your ex sues you for the payment of the attorney's fees, you will probably lose. If you decree ordered you to pay the fees, you're obligated to pay them. Have you tried taking out a loan to pay off the ex and keep her from holding this over your head? I would strongly consider taking the signed divorce decree to an attorney for review and to figure out what your options are. Perhaps you can negotiate the fee repayment with a close reading of the decree and the help of a good lawyer.
