If I file for divorce does my husband need to pay me alimony

Ava Gail Gutfriend
Answered by attorney Ava Gail Gutfriend (Unclaimed Profile)
Divorce lawyer at Law Office of Ava G. Gutfriend
If you were to file for divorce you may obtain temporary spousal support.  You would request this  in your divorce application.   The request for a divorce by you has nothing to do with the issue of temporary  support or child support. The issue of maintenance (alimony) is dependent on many facts  about your marriage.

Will the United States recognize a divorce that is granted in Mexico?

If the divorce is legal in Mexico, it should be legal here. INS may want specific documents to prove it was legally done, so check with them.

Can a married person enter a common law marriage if I live in New York and I know it's not legal here but even if it’s in a different state?

Answered by attorney Seth David Schraier
Divorce lawyer at Law Office of Seth D. Schraier, P.C.
You can enter a common law marriage in another state, however, since New York State does not recognize common law marriage, you will not be considered married under the laws of New York. This also means that until you obtain a legal marriage in another state or New York, then even if the marriage is recognized in another state, you would not be able to file for divorce in New York State.
