After three years, it would probably be reasonable to do so, but you should give him official notice of your intent before you do it. Send him a certified letter giving notice that you will be disposing of it in 30 days if he does not make an arrangement to come and get it.

It doesn't matter where you were married.  However, it does matter where you live.  If you are a resident of CA--then you would be able to file in the county in which you reside.  Your spouse would need to be served in the state in which he resides.  A divorce in CA takes a minimum of 6 months and 1 day from the date of service.  Other states may have different time periods and different rules regarding divorce. We can help you in CA if you are interested.

Assuming that there is no lease between you and the owner, his mother can ask you to leave within a reasonable period of time (no more than 30 days, I would say). If she doesn't get involved, then no one has to move at this time.
