If it was the Petition for dissolution of marriage, his signature is not required. If it was some kind of settlement agreement, it does require his signature.

You can file for divorce and ask for exclusive possession of the house. Or you and the children can leave the house and go perhaps to the rental property or wherever you would be safe.

Child and spousal support are based on the relative incomes of both parties. You should talk to an attorney in your county to get a better idea of what kind of support obligations you may be facing. California is a no fault divorce state so even if your wife leaves you, you may still have to pay child and/or spousal support. Good luck!
