How long do I have to wait to get a divorce?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
In Arizona, there is no waiting period. As long as either (or both) of you has lived here for more than 90 days before you file, you can file immediately. I recommend you consult with an attorney to discuss this matter in greater detail.

Can a separated parent relocate the kids to another state legally?

Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
Generally if you are divorced (or legally separated in a judicial proceeding) and your parenting is subject to an order of the Court you can ONLY move with an order of the Court.. That order is potentially tough to get if the children's other parent objects. The standards are multiple and you have to have a good reason for upsetting his parenting time.(I recently got one for a client to move with her daughter out of the country .. over the objection of the other parent... but it took a lot of time and money.. and some great reasons!) However if you are merely informally separated and your children are not under an order of the court as to parenting time you may not be subject to any restrictions.
