You should have a contract, called a retainer agreement, that outlines what the attorney was supposed to do for you. Whether you do or don't, under the circumstances you should probably fire your attorney and demand a 100% refund of your retainer fee within a reasonable time (3 days). If you don't get your money back, file a formal complaint with your State Bar. While that is pending, get a new attorney to proceed with your divorce.

Wife can file for divorce at any time. The fact that her husband is currently in jail does not require her to wait until he is released from jail before she can file for divorce.

You should talk to an attorney in your area. As a general rule she is only entitled to 50% of what came to the family unit while married. She should have no claim to the farm or to long term alimony based on these facts.
