It's likely that you'll have to pay some transitional support for perhaps a little more than a year...but it's dependent upon whether you have that ability and the reason why your husband is unemployed.

Can I file an adultery charge to contest a divorce and send a subpoena to the third party?

California is a no-fault state, if you are in California, you simply file that there are irreconcilable differences (without naming what those differences are). If you are in a state that requires one of you to blame the other and state a reason, why don't you file the case and state that she is committing adultery and request divorce?

Can my 16 years old son leave the house and go to another state for sachool and we live in New York thank u

Answered by attorney Lori Nevias

If it's a boarding school, yes. If it's not a boarding school, it depends on the law of the other state. The person who will be your son's guardian (I assume you're not considering sending your 16- year old out of state to a non-boarding school without a guardian on the other end) would have to find out the procedure for getting appointed as guardian. They need to also check the applicable laws regarding any residency requirements for school attendance.
