Need to divorce. DOn't know where spouse is

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
There is a way that you can file for divorce even though you haven't seen your spouse.  You will have to prove that you tried to find him, and tried to serve him with the pleadings, but at this point, your cause of action is going to be abandonement, because you haven't seen him.  There are "pro se" packets at the county court.  That is a packet that you can use to file for divorce if you do not have an attorney.  Good luck

Can an attorney subpoena bank statements and loan papers from a spouse and have them by Dec. 12th 2013 (almost 2 weeks)?

Answered by attorney Bruce Provda (Unclaimed Profile)
Divorce lawyer at Provda Law Firm
First you should contact an attorney, they will know how to subpoena records and other information. Do not try to do this alone as the other party is most likely represented by counsel.

Does it matter who files divorce papers

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
Usually it does not.  If one party files first and both parties are filing without another cause of action like adultery or something like that, ten it doesn't matter who is the plaintiff and who is the defendant.
