The court will at least set a status conference. CA is a No fault state so divorces are usually no fault. It still means all the paperwork has to be properly done and there is a lot if it.

Good question. A divorce terminates a marriage. It returns you to the status of an unmarried person. An annulment makes the marriage cease to exist. It returns you to the status of a single person (never married). It essentially erases the marriage. Some are void from the beginning and others are voidable. It is a complicated area and requires a hearing and proof. Annulments are not so easy to get and there are timing requirements, so it must be requested usually within two years of the marriage. Unlike marriage there is no residency requirement Dissolution is six months residency in California. Some of the reasons are: *Minority* - under the age of 18 without parental permission and court order. Must be filed within 4 years of reaching 18 years old. *Bigamy* - being married to another at the date of the second marriage. *Unsound mind* - At time of marriage was of unsound mind, but if later of sound mind and remained married it is not voidable. *Fraud* - if consent was obtained by fraud and after the fraud was discovered the party filed, instead of waiting a year or two. Must be to a matter of substance and directly affects the purpose of the deceived party. (intent to ignore marital obligation of fidelity is one. (not lies about financial status or that one doesn't want to work) 4 years to file after discovery of facts. *Force* - shotgun wedding, threats may be enough, if you do not thereafter cohabitate. 4 years after date of marriage to file. *Physical Incapacity* - Inability to engage in normal copulation at time of marriage. 4 years of date of marriage and can only be filed by the non-incompacitated party.
