Settlements are community property. Moreover, you own the home jointly. Because you are not a plaintiff, the attorney is NOT required to put your name on the settle to check. However, you are entitled to your interest in the settle to under CA law.

The community probably has an interest in the house. In CA it is a formula based on principal paydown and percentage of appreciation. If you refinanced there are other rules that come into play. See an attorney. The community could have more of an interest than you do alone. You are half the community.

Because Ghana is not apparently a party to the Hague Convention governing service of process you will need to contact an attorney in Ghana to find out how to accomplish service under the law of that country.
