What you heard is incorrect. You have to retain your own lawyer, regardless of who filed for the divorce. However, if there is a disparity in the amount of income each party has the Court can require that the party who makes more pays for both attorneys - or at least some of the other attorney's cost.

You can't mail a summons and complaint - it has to be served personally. And if the case is truly uncontested he needs to appear before a notary and sign the required documents.

There will be residency requirements that, in your case, the facts indicate that your satisfy, as you both live in New York, you were married in New York, and some of the treatment to which you are being subjected seems to have happened in New York as well. To file for divorce in New York, you will need grounds, which is kind of your reason for divorce.  They include abandonment, terrible treatment, and a total breakdown of the marriage.
