First, talk with your attorney about options to postal or personal service. In Ohio we can serve by putting a notice in the newspaper. Second, do not knock Legal Aid attorneys. I volunteer my time with the Legal Aid Society and am proud of my Legal Aid work.

If the house was paid off prior to your marriage then you have no claim to any of the equity. However, your husband will have to account for mortgage payments made with community funds and buy you out.

Under Washington law, if he signed a quit claim, then it would appear he no longer has any ownership interest. He may want to consult with a probate attorney as to what is likely to happen with regard to the mortgage and her estate. It may well be that whoever inherits the house will need to take over the mortgage in order to avoid foreclosure.
