How can I find out about pension benefits for myself as my husband will be retiring soon?

Stephen A. Teller
Answered by attorney Stephen A. Teller (Unclaimed Profile)
Divorce lawyer at Teller law
First, try calling the employer's human resources department and asking them about you and your husband's retirement plan. They may give you the information you need. If not, you can get it from your husband in the "discovery" phase of the divorce process. He needs to give it to you, but you may need a lawyer to make him see that if he won't give it to you easily. This communication is confidential attorney client &/or work product privileged.

Do I have to file for divorce in the county where I reside?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
In Florida, you have to file in the county where you last resided together as Husband and Wife. The fact that your Wife works for the Clerk's office will not affect your case. It would only be a conflict if she worked for the Judge assigned to your case.

Was she allowed to move the children across the country without my written consent?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
You know what? You need to get a family attorney on your side. Without one you are lost. I have handled many situations that are very similar to yours and so have attorneys in your area. Get one now. It can be ordered that she must return the children to the state of Florida if she left without your written permission or without a court order allowing it. It can also be ordered that you are to be given credit for the support that you have paid. You can probably file a supplemental petition for modification as well.
