Is a preliminary hearing and questionnaire by the judge necessary in a no fault divorce?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
The court will at least set a status conference. CA is a No fault state so divorces are usually no fault. It still means all the paperwork has to be properly done and there is a lot if it.

Is there anything else I need to do since I wasn't able to file the Judgment Package until after the 6 month mark?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
If I understand your question, you are asking if the 6 month mark is a deadline to get your divorce finalized. In California, the 6 month mark is the MINIMUM required time to finalize your Dissolution of Marriage. The court will not finalize the divorce until 6 months and one day after the other party was served with the Summons and Petition, you may file your paperwork before the 6 months, but it won't be finalized until after that date. You may also file your paperwork after 6 months and it will be finalized immediately because you are already past your minimum 6 month waiting period.

Can I submit divorce papers to the court without my husband's signature?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
If your husband won't sign an agreement you can file and serve papers on him. If he doesn't respond then, you can move forward with the divorce without him. There doesn't have to be an agreement to get a divorce in California
