I'm not sure how the name change could have occurred without your mother knowing because its usually something that you specifically have to ask the court to include.  You can always ask to amend the judgement of divorce to allow her to keep her name.  Usually when someone resumes using her maiden name, they use the judgement of divorce as proof that they are changing the name back.  if your mother wants to keep all of her things in the same name she has had, she just won't take that affirmative step of changing things.

Thank you for your question.  It sounds like you are in a tough position and need some information with regard to your situation.  Generally speaking, income earned during a marriage does not belong solely to one party or to the other, but is rather considered to be marital in nature.  Likewise with any assets and/or accumulated during a marriage, including retirement accounts, or credit card debt incurred to provide for the family.  In addition, someone in your position may also be entitled to alimony and child support. I strongly suggest that you schedule a consultation with an experienced family law attorney who can discuss your specific circumstances with you and help you strategize to move forward.

Alimony is called "Spousal Maintenance" under Washington law. The governing statue is RCW 26.09.090 which directs the court to consider the following factors in determining whether and to what extent maintenance shall be awarded. The length of the marriage is only one factor. 1.The financial resources of the party requesting maintenance after the divorce depending on other assets awarded, etc 2. The proposed vocational/educational plan of the party requesting maintenance 3.The standard of living established during the marriage 4. the duration of the marriage (the duration of the pre-marital relationship is not enumerated in the statute; but in my experience some judges will consider that as well) 5.The age, physical condition and emotional condition of the party requesting maintenance 6. The financial resources and ability to pay of the other spouse after the divorce depending on earning capacity, other assets awarded, etc.
