Can my husband force me out of our home?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)

Your first step, in prudent self-protection, is to consult an experienced family law attorney. Assuming you live in Wisconsin, the marital assets and debts are presumed to be split 50/50although there are lots of recognised reasons why the parties, or a court, may modify that proportion. If you are an owner of the house, your spouse can not turn you out of the house, except through a temporary order from a family court (or on a harassment injunction, which does not seem likely). In a divorce, you might very well be a candidate for maintenance (= 'alimony') both on a temporary and longer basis. You will probably have to seek work. But all of these matters are highly fact-driven. Find a good lawyer and discuss the whole situation with him or her.

Does it matter who the petitioner or the respondent is in an annulment/divorce?

If you are Petitioner you can default the other side if they don't respond. That's really the only benefit.

Can my husband continue filling for divorce without my signature?

If he has an attorney you should get one too. If you dont pick up the papers he will have to get you served. After you are served you have 30 days to respond. He can move forward with the divorce after you are served regardless of whether you sign a trying or agree. In California he has a right to a divorce and doesnt need any grounds other than he says the marriage has broken down.
