You file and have him served. There are always some minimal assets (e.g. household furnishings) which you must list along with any debts in either of your names incurred during the marriage. If he doesn't respond to the petition, you can get a decree by default.

It depends on your local court system. In my area once a case is filed you call the judge's legal assistant and request a date for the final hearing, here that is less than 30 days from filing.

If he does not have a right to the house at the end of the divorce it should be awarded to your mother and he would have to move out.
