Can my husband get any of my workerman's comp settlement? We live in NY

Answered by attorney Randy S. Margulis

I'm assuming you mean as part of a divorce settlement or judgment of a court.  To the extent that such an award represents lost economic benefits during the marriage, that would be subject to equitable distribution.  But if your award represents pains and suffering, for example, or other non-economic benefit, then you're safe.

To answer that requires more information. And if your husband is the spouse with the money he'll probably be required to pay for your lawyer too. Consult one!

I don't know what you mean by "a new State court." But if there's an order, unless it is altered, you are required to pay.
