Custody is not based on who has been the primary caregiver - although that is a factor. The test for custody - if it is litigated - is the best interest of the child. Moving, alone, is not a determinative factor. You should discuss the situation in detail with a local divorce attorney, sooner rather than later.

There is no legal requirement that you keep her insured. However, you could be held responsible for her medical bills if you're still married. If you file for a divorce the issue will be resolved in the course of the divorce case.

The best thing may be for your spouse to get an attorney in the divorce to assure that everything is done knowingly. You (or your spouse's family members) might also need to enlist the help of a guardianship lawyer, who can move to get an adult guardianship over your spouse and then help direct the progress of the divorce on your spouse's behalf.
