You can have the papers served immediately, but how quickly you are divorced may depend on whether your spouse is mentally capable. The best thing may be for your spouse to get an attorney in the divorce to assure that everything is done knowingly. You (or your spouse's family members) might also need to enlist the help of a guardianship lawyer, who can move to get an adult guardianship over your spouse and then help direct the progress of the divorce on your spouse's behalf. Good luck.

There are a number of issues that need to be addressed; custody, support, maintenance and division of property which  includes his degrees/license.  I suggest you get your financial  documents in order and seek assistance from a qualified matrimonial attorney who practices in the county that you will most likely file the action.  However, one is hopeful, that issues can be resolved with a stipulation of settlement.
