There is no requirement that the papers be signed. There is a requirement of a response. If the response is not appropriate one can move for a default. As to refusing to accept papers - that's a concept that doesn't make sense. If service is validly executed whether the papers are "accepted" or not is irrelevant.

It's not clear what you mean by "registered" - there is no requirement that a marriage be registered in New York. Recovery of gifts is generally negotiated - litigation can cost far more than most gifts.

You can enter a common law marriage in another state, however, since New York State does not recognize common law marriage, you will not be considered married under the laws of New York.
