You will not get a default and even if you do, it can be set aside. The law requires that matters be heard on their merits, particularly in family court, so deadlines on legal documents are not strictly enforced. The question becomes what is your husband contesting? If there truly is no property, and issues regarding the children have been resolved, why will he not agree to terms for an agreement to be filed and a Decree entered on that agreement? You should explore your case from that perspective, and work toward getting a Decree entered by agreement.

You do not need the wife to "give" you a divorce. She does not have to agree to anything, but then the court will need to decide all of the issues, including whether the divorce should be entered. Hire an attorney.
