Who gets to stay in the house until the divorce is over?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
If neither party can afford it you have answered your own question, the marital home will have to be sold and whatever equity remains will be split between the parties. In the meantime, and during the pendency of the divorce, both parties have equal right to live in and use the marital residence for their lodging, unless there are other issues of spousal abuse or harm to each other or the children.

Where do I stand on who gets the house?

There are too many variables in a divorce case to isolate an answer concerning a single asset. The judge will look at everything in the marital balance sheet and divide the property in what the judge thinks is a fair manner. I suggest you hire a lawyer.

You are not divorced until and unless a judge enters a final judgment or final decree of divorce. So, no you are not divorced and need to file a legal action.
