If you inherit money while married do you split in in a divorce ?

David J. Hutchinson

This is not a yes or no question. If the inheritance is kept separate by the spouse who inherits it (not commingled with marital funds, like in a joint bank account), they have a decent argument NOT to split it, especially if it was inherited around the time of the divorce. If commingled, it is likely to be split. Depends on a lot of things, including how large the inheritance was and how many other assets there are. Good Luck.

Can my wife sell one of our vehicles without my approval?

Each spouse has a fiduciary duty to preserve and protect the community estate for the benefit of the parties. Her conduct did not preserve the asset. As this transaction has been completed, your remedy would be in the specific distribution of the balance of the community estate during the divorce case if a divorce is going to happen. You can also consider a request for court order for her to return to you the remaining vehicle as the other vehicle was sold without your knowledge or consent until after the transaction was complete.
