How do I file for divorce if I do not have money for large attorney fees and we have a son together that I don't want him to see?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
Unfortunately, due to the issues surrounding your case (having children, one of whom has been abused by your ex husband), it will be very difficult for you to pursue this case on your own. You want to ensure that you receive as many protections as you can for your children as well as whatever you are entitled to financially (child support, your share of community property, etc.). As such, I recommend contacting several local attorneys and asking them if they offer payment plans or alternative billing arrangements to handle cases like yours. If you don't find any attorneys willing to take your case at a reduced fee or willing to make payment arrangements, my next suggestion is to ask for help from close family and friends. You need a qualified attorney's representation for the best possible outcome. Good luck.

Which is better for us, annulment or divorce?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Divorce lawyer at Anthony Overton Van Johnson Associates, P.C.
First of all, there are very specific requirements you would have to meet for an "annulment". Merely having a brief marriage does not satisfy the requirements for an "annulment". I have represented couples in the past with marriages that terminated in 30 days or less. Regardless of the length of the marriage, if you do not meet the statutory requirements, your request for an "annulment" will be denied and you will have to proceed with a divorce action.

Can my Ex Spouse take my only childhood home of 48years and sell it

Zoe Ann Meigs
Answered by attorney Zoe Ann Meigs (Unclaimed Profile)
Divorce lawyer at The Law Office of Zoe Meigs, P.C.
If the house was awarded to your ex-wife in the divorce decree, then she has the right to sell it.  You need to check the divorce decree itself as well as look at the real property records at your county clerk's office.  When you inherit real property it becomes your separate property.  In a divorce a court may only divide community property.  You may need a lawyer's help to file a Bill of Review to attempt  to overturn the award of your separate property home to your ex-wife in the divorce.  The fact that you say you "signed off on" the divorce may be a problem, however, if the decree provides that the house was awarded to your ex-wife.  Do not wait any longer to resolve the title and ownership issues with this real property.
