There is a possibility that she may be entitled to one-half of the increase in value, starting with the value of the plan on the date you were married to her until the date of the divorce. Yes, you will need to have your husband served with the divorce petition. If you do not know where he lives, you may want to hire a private investigator to assist you in finding an address for him. Otherwise, you will probably need an attorney to get your divorce approved by a court because they will not do it you cannot get him served with process.

In Texas, your husband would have to file a notice of non-suit. Do not count on him filing the notice of non-suit if you are served. Once you have notice you will only have the Monday following 20 days from the date of service to file an answer. If you do not file an answer he can default you.If you have an answer at least you are somewhat protected from a default. If he really wants to stop the divorce he would not go through the expense of having you served. Contact a local divorce / family lawyer in your area.
