However, if the divorce is truly constructive (or 'amicable'), the lawyer can represent one party, and the other party can do his or her best to reach fair and equitable agreements. The other party can rely on this sort of undertaking, or get his or her own lawyer. Getting a separate lawyer is usually the best idea.

You can file the divorce in the state in which you live. It's the only state that has jurisdiction. He has to be served wherever he lives now. Best if you get an attorney who will make sure everything is properly done and will explain the law to you.

Filing does not get you a court hearing or a court date. If you want him t make the payments you need to file for a hearing. If you want the divorce done, there are a lot of documents that need to be filed apart from the initial paperwork.
