Your boyfriend is married. Until he divorces, your marriage to him would be bigamous necessitating annulment.

What should I do if my ex has filed a hearing for modification?

Answered by attorney David Ari Goldberg
Divorce lawyer at The Goldberg Legal Group
You need to file an opposition to the modification. You were in a long term marriage so generally you would receive spousal support ("alimony") for about half the length of the marriage. You were given the opportunity to become self supporting by the court in the last 7 and half years. So now your ex husband is seeking to modify the spousal support because he has been paying for approximately half the length of the marriage. You should continue to work on your education and become fully self sufficient.

Do we have to have agreement first on the terms in order to complete before year end?

You would have to be served 6 months and one day before the end of the year for it to be final this year. Unless it was filed in June and you were served? before June 30 it could not evenbe final by the end of the year for status purposes. I am not sure where you are getting the number $50,000. as a property settlement. I s there $100,000 of community property. If not you are not entitled to $50,000. If there is over $100,000 in community property you should get 1/2 of whatever that amount may be.
