Legally separated who is in charge of funeral

Morghan Leia Richardson
Answered by attorney Morghan Leia Richardson (Unclaimed Profile)

The legal separation agreement generally severs the spousal duties. Unless the husband has a will asking that the wife be in charge, then it seems that the husband's heirs no longer include the wife. You would be best off talking to a trusts and estates attorney. Good luck.

Yes, it can be filed here, though there may be a few issues to resolve in terms of paperwork. If you have no children and no property to divide it need not be very expensive. If you're in the New York City area or suburban counties (Westchester, Rockland, Putnam, Nassau or Suffolk) please feel free to get in touch.

It's not clear what you mean by a brief after a trial. Usually the trial ends with a decision.
