I think you are asking if you can live together and be legally separated.  You can enter into a separation agreement but you would likely want the terms of such an agreement to specify who is entitled to live in the apartment and who needs to move out.

If you were awarded the house in the divorce, he has absolutely no right to come into the house, whether you are there or not. You can invite him in but he cannot come in without your permission.
