You don't provide enough information to understand what your problem is. But, the simple answer is that if there is no divorce case or court order involve, any deadlines are established by the pension plan administrator and that is who you need to talk to.

You need to file in the U.S. in the state and county of your domicile. "Legal Residency," or "domicile", on the other hand refers to the place where a military member intends to return to and live after discharge or retirement, and which they consider their "permanent home." Legal residency determines what local (state) tax laws a military member is subject to, and in which local (city, county, state) elections they may vote in. In your case, it sounds as if you will file in Bexar County, Texas. You should speak to someone in JAG to ask them additional legal advice, as any advice from the JAG will be provided free of cost.
